Mich Exec Order No 2020-188 rescinds Mich Exec Order No 2020-174 and extends the restrictions on entry to health care facilities, residential care facilities, congregate care facilities, and juvenile justice facilities. There is no end date in the order. The new order contains all of the provisions of the previous order and extends authority to the director of the Department of Health and Human Services (DHHS), as described below.
Allowed Visitors. These facilities may allow only the following visitors:
- those necessary for the provision of medical care;
- those necessary for the support of activities of daily living;
- those necessary for the exercise of power of attorney or court-appointed guardianship for an individual under the facility’s care;
- a parent, foster parent, or guardian of an individual who is 21 years of age or under and who is under the facility’s care;
- those visiting an individual under the facility’s care who is in serious or critical condition or in hospice care;
- those visiting under exigent circumstances; and
- those visiting for the performance of official government functions.
For other potential visitors, these facilities must make best efforts to enable visitations by phone or other platforms.
Residential care facilities include homes for the aged, nursing homes, adult foster care facilities, hospice facilities, substance abuse disorder residential facilities, independent living facilities, and assisted living facilities.
Health Evaluations of Visitors. Health care facilities, residential care facilities, congregate care facilities, and juvenile justice facilities must perform a health evaluation of all individuals (who are not under the care of the facility) each time the individual seeks to enter the facility. The facility must screen for signs of respiratory infection, such as fever, cough, or shortness of breath, and contact with someone with COVID-19 in the last 14 days. All individuals who don’t meet the evaluation criteria must be denied entry.
DHHS Authority. The director of the DHHS may issue orders and directives to implement this order, including to specify exceptions to the allowed visitor restrictions and to specify additional evaluation criteria for the health evaluations.
Protective Equipment. All staff members and visitors must wear a covering over their nose and mouth when indoors or within six feet of another person.
